America’s Future filed an Amicus brief with the Supreme Court of the United States (SCOTUS) yesterday (May 24) in National Rifle Association of America (NRA) v Maria T. Vullo, SCOTUS Dkt. 22-842. The brief was filed in defense of the First Amendment rights of speech and association and to defend the rights of all citizens and organizations to be treated fairly and even-handedly by government officials no matter the political preference.
On Friday, May 19, 2023, America’s Future filed an Amicus brief with the Eighth Circuit Court of Appeals in U.S. v Missouri, Dkt. No. 23-1457, a case concerning state sovereignty under the constitutional principle of dual sovereignty, a notion that provides for the vast scope of states’ powers to ensure we live with a sense of ordered liberty.
On Monday, May 15, 2023, America’s Future submitted comments opposing the U.S. Department of Education’s (DOE) Notice of Proposed Rulemaking (NPRM) published in the Federal Register on April 13, 2023, announcing the intention of the Biden DOE to amend the Education Amendments of 1972, specifically Title IX, in a manner blatantly contravening the expressed will of Congress and patently detrimental to young women.
On May 4, 2023 the United States Court of Appeals for the Fourth Circuit granted a Motion for Leave to file an Amicus brief submitted by America’s Future along with five other nonprofit organizations in B.P.J v West Virginia State Board of Educators (WVSBE), et al., Dkt. No. 23-1078 (4th Cir. 2023).
On April 27, 2023, America’s Future, along with three other nonprofits, submitted an Amicus brief with the Supreme Court of the United States (SCOTUS) in Tingley v Ferguson, Attorney General for the state of Washington, et al., Dkt. No. 22-942, a case involving the First Amendment right to freely speak and freely exercise one’s religion.
On Thursday, March 30, 2023, America’s Future submitted an Amicus brief with the United States Court of Appeals for the Second Circuit in Soule, et al v Connecticut Association of Schools, Inc., Dkt. No. 21-1365 (2nd Cir. 2021) in a student athletics gender policy case.
On March 16, 2023, America’s Future along with three other nonprofit organizations jointly moved Arizona’s Supreme Court seeking Leave to File an Amicus brief respecting two cases consolidated for appeal and docketed under Lake v Hobbs, Dkt No. CV-23-0046-PR.
On Feb.28, 2023, the United States Court of Appeals for the District of Columbia affirmed the dismissal by the lower court in the case, State of Illinois and State of Nevada v David Ferriero, USCA-DC Dkt. No. 21-5096 – one in which America’s Future had filed an Amicus brief applauding the lower court’s dismissal and urging the Appeals Court to do likewise.
On Tuesday, January 31, 2023, America’s Future joined six other tax-exempt nonprofit organizations to submit an Amicus brief to the United States Court of Appeals for the Sixth Circuit in Tennessee, et al. v Department of Education, 6th Cir. Dkt. No. 22-5807 (2022), arguing the lower court appropriately issued a preliminary injunction enjoining the Department of Education (DOE) from implementing a Final Agency Interpretation document published in the Federal Register on June 22, 2021, which indicated an intent, on the part of the administration and its agencies, to wildly misinterpret and misapply the 2020 SCOTUS decision in Bostock v Clayton County, 140 S. Ct. 1731 (2020) in an effort to materially modify Title IX’s prohibition on sex discrimination.
On Wednesday, December 7, 2022, America’s Future, along with two other nonprofit organizations, submitted an Amicus brief to the Supreme Court of the United States in Gonzalez v Google, Dkt. No. 21-1333 (2022),
