What Would Thomas Jefferson Say?

Newsletter | September 21, 2023

Last week, Joe Biden’s corrupt Justice Department filed a motion to gag the Republican frontrunner in the 2024 election, Donald J. Trump. It seems the emotionally vulnerable and mentally unstable prosecutors in the Special Counsel’s Office don’t like reading the 45th president’s posts calling them out as a “team of thugs.” Or maybe they’ve just found another excuse for interfering in the 2024 election by silencing Trump.

At this stage, the DOJ has become a parody of its former self — a dangerous parody. The once venerable law enforcement body has spent nearly a decade hunting America First supporters, framing President Trump as a spy and a criminal, and hollowing out the First Amendment. And at the same time, it ruthlessly dispatches SWAT teams to arrest pro-life activists at gunpoint, it whines that Trump’s posts on social media defending himself against felony charges are “disparaging” the prosecutors. What a farce.

The DOJ states in its motion that President Trump needs to be gagged because “the defendant’s repeated posts that he cannot receive a fair trial from this Court or from a jury of his peers in this District are substantially likely to undermine confidence in the justice system, affect the jury pool, or otherwise prejudice the due administration of justice.” The motion is absurd on its face.

Trump has been charged in a Washington, D.C. federal court with four felony counts tied to the January 6 protests on Capitol Hill. Considering convictions of January 6 defendants are upwards of 99.8% and in light of over 92% of D.C. votes cast in the 2020 election went to Biden, the likelihood of Donald Trump being convicted in that jurisdiction is a no-brainer.  How could his social media posts possibly prejudice a jury pool that votes overwhelmingly for the Democrat Party candidates against a Justice Department weaponized by Democrats?

Remember, it’s the same Justice Department that spied on President Trump and his first administration in 2016 while “investigating” a fraud they themselves manufactured. In 2020, the DOJ censored social media to shield his opponent, Joe Biden, from evidence of his and his family’s rampant corruption. It didn’t stop there. Since leaving office and ramping up his 2024 run, President Trump has been indicted on 91 charges in federal as well as state jurisdictions.

For eight years in the hunt to get Trump, the ruling establishment and the institutions they run have interfered with every election, polarized a nation, impeded public discourse and debate on important issues of our time, and silenced America First supporters who disagree with their globalist agenda.

The blatantly political persecutions designed to interfere with the coming election have awakened more and more citizens to the plain truth spoken by Founding Father Thomas Jefferson: “All tyranny needs to gain a foothold is for people of good conscience to remain silent.”

What truly worries the DOJ and its political masters aren’t Trump’s social media posts, but that more and more Americans are raising their voices in protest. Americans will not be silent and won’t be gagged.

America Patriots - Boone Cutler

Boone Cutler is a combat veteran and an influential advocate for the Warfighter community. His experience serving in the heart of Sadr City as a Psychological Operations team sergeant became the cornerstone for his first book, “CallSign Voodoo,” written in the throes of battle and completed during his recovery at Walter Reed Army Medical Center. It paints an intimate portrait of the Sadr City conflict and the issues faced by patients at Walter Reed during the neglect scandal of 2007, the dark tunnel of prescription drug addiction, and the beacon of alternative medical treatments. He also co-authored with General Mike Flynn, “The Citizen’s Guide to Fifth Generation Warfare,” a comprehensive series of military manuals that delve into modern warfare dynamics written specifically for civilians to easily understand. We spoke with Boone recently about Fifth Generation Warfare and other challenges our great country is facing.

Can you give us a brief definition of Fifth Generation Warfare?

All generations of war are based on technology. The first generation of war was pre-gunpowder, and now, in the fifth generation of war, it’s about controlling the population through the manipulation of the cognitive battle space. It’s also the merging of economic, political, legal, cyber, and psychological warfare, all aimed at the populace. By its nature, Fifth Generation Warfare is unrestricted.

What is the best way for us to fight Fifth Generation Warfare?

The best way to approach the subject is with enough humility to realize it requires real training that is much more than a single podcast or article can provide. If General Flynn and I could have explained the subject with less than a few books, we would have, but it can’t be done. Everyone is involved in this war. Your family and friends are deep in it, and it’s done with an unseen hand. There’s a way to fight and win, but the first objective is having the true desire to learn how with a comprehensive approach.

As a combat veteran, why do you think the armed services are having such a hard time meeting recruitment quotas?

For one, the recruiters are being held to a higher standard. In the past, new recruits could slide by with an issue or two, and for the good of the soldier, the recruiter helped where they could. Today, they’ve been hamstrung by military bureaucracy, so fewer people are able to make it through the process. Also, a lot of today’s youth can’t meet the basic physical fitness requirements. The lack of physical education in high school and the “online culture” has weakened the physical strength of young Americans.

Lastly – as a nation, we have a credibility problem. Our people don’t trust the political leadership of our country after being stuck in endless wars without America-first objectives. General Smedley Butler and President Eisenhower were both right. War is a racket that supports the military-industrial complex, and now everyone sees it. Sadly, our country’s political leadership has utterly failed us. Warfighting sure is a lot of fun, and I’m proud to have served with great people. It’s sad the fervor for it has reached such a low point because nobody wants to sacrifice for a war that we aren’t allowed to win.

Volodymyr Zelensky was at the UN this week asking for more aid after U.S. taxpayers have already sent hundreds of billions of dollars. Does the US have an interest in supporting Ukraine to this extent?

Politics aside, the ability to assess Russia’s fight capabilities against U.S. technology has been good. Our Special Operations Forces trained Ukrainians, and I’m sure we’ll see refinement in that area as well. I don’t want to go to war with Russia, but I feel like things are moving in that direction, so it’s best to get a good look at their cards now. From a political perspective, we need political leadership that Putin respects and can put an end to it. But the road to that conclusion gets longer every day. Whatever caused this whole thing needs to be brought to light, honestly. And lastly, war should never be a slush fund for globalists or a ruse to launder money. The lack of financial accountability needs to be resolved before any money is sent anywhere, ever.

What is your prayer for America?

People are waking up in droves and seeing the manipulation that’s causing the polarization. I pray Americans and all of humanity recognize the Chinese Communist Party and the UniParty for the evil they are and take action against them.

In the newly released episode of America’s Future Not On My Watch podcast with host and investigative reporter, Liz Crokin, you’ll meet the fearless John Amanchukwu. This pastor and author of “Eraced: Uncovering the Lies of Critical Race Theory and Abortion” does not mince words in his effort to expose the decline of education in America by those who allow pornographic books in schools. His goal is to protect children and encourage the nation to return to the basics that made America great – faith and family.

Some readers may have seen a viral video of his stop in Asheville, North Carolina, where he read aloud to school board members explicit sex acts described in a book available to school children as young as 10 years old and was quickly told to stop. “When we banned the Bible, the education system took a downward spiral…I’m trying to confront school boards around the country, and I’m just getting started.”

Indeed, Pastor Amanchukwu is taking on the woke culture with a fierce passion and is unafraid to speak out about the destructive influences on our society of such ideologies as CRT and DEI. The interview is wide-ranging and includes his stance against abortion, particularly in the black community, gender theory, the need for parents to engage in active conversations with their children, and his work alongside TPUSA Faith to travel to school boards across the country to protect children. He urges that “parents should know the education standards that their school has enacted. They should know what’s in the library. They should be engaged at all times.”

In Focus Using The Congressional Impeachment Power

May A President Be Impeached for Mental Impairment?

This is the sixth entry in our IN FOCUS section examining the impeachment power to help give readers a historical and constitutional context to this political process. To access previous articles, please click here.

House Republicans finally have set a date to begin impeachment proceedings against President Joseph Robinette Biden, Jr.  The inquiry will kick off with a hearing on Thursday, September 28 before the House Oversight Committee.  This first hearing apparently will deal more with constitutional and legal issues than presenting evidence — but they need to begin somewhere.

Don’t expect to read much about the impeachment from our Deep State-controlled press.  Last week, the White House issued a directive to U.S. news organizations as to how it should cover the Biden impeachment, boldly entitled:  “It’s Time For The Media To Do More To Scrutinize House Republicans’ Demonstrably False Claims That They’re Basing Impeachment Stunt On.”  The author was “Ian Sams, Special Assistant to the President and Senior Advisor and Spokesman for White House Counsel’s Office.”  The directive stated: “It’s time for the media to ramp up its scrutiny of House Republicans for opening an impeachment inquiry based on lies.” (Emphasis original.)  Attached to the memo was a “14-page appendix,” which the memo claims “comprehensively addresses the 7 key lies House Republicans are suggesting they are basing an impeachment on.”  (Note that this “spokesman” for the White House Counsel’s office ended this sentence with a preposition.)  The 7 charges against Biden addressed in the press directive are that:

  1. Biden engaged in a bribery scheme with a foreign national;
  2. Biden got the Ukrainian prosecutor general fired in order to help the company where his son served on the board;
  3. Biden participated in his family’s global business ventures with America’s adversaries;
  4. Biden is compromised by deals with foreign adversaries and it is impacting his decision making;
  5. The Biden Administration interfered with the investigation of Hunter Biden;
  6. The Biden Administration stonewalled congressional investigations; and
  7. Biden changed his story on his involvement with Hunter’s business dealings.

Thus far, almost all of the grounds for impeachment of President Biden that have been raised have focused on corrupt actions committed while he was serving as Vice President from January 2009 through January 2017, and dereliction of duty while serving as President.  But today we address a different issue as President Biden deteriorates mentally — can he be impeached for mental incapacity and the inability to do his job?

A May 2023  poll by leftist National Public Radio found that Americans believed, by a 62-36 percent margin, that Biden’s notable mental stumbles are a real concern as he plans a run for a second four-year term.  What does the nation do if the President is alive, will not resign, but is obviously suffering from extreme mental deficiencies?  What constitutional options are available?

During the debates on adoption of the Constitution, some Founders argued that impeachment’s sweep should include protecting the nation against the mental decline of a President.  James Madison, for example, argued it was “indispensable that some provision should be made for defending the community against the incapacity … of the Chief Magistrate” as “[l]oss of capacity might be fatal to the Republic.”  Gouverneur Morris also argued that “incapacity” of the President would be among the “causes of impeachment.”  Raoul Berger, Impeachment (Harv. U. Press:  1999) at 189-190.

Nevertheless, Article II, Section 4, specifies that impeachment was to apply only to “high Crimes and Misdemeanors” – and that is quite different than mental incapacity.  The problem of Presidential incapacity originally was covered briefly elsewhere in the Constitution — in Article II, Section 1 — which provided that:

In Case of the Removal of the President from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, the Same shall devolve on the Vice President, and the Congress may by Law provide for the Case of Removal, Death, Resignation or Inability, both of the President and Vice President….  [Emphasis added.]

Not until 1967 did Congress finally fill in the details of “inability to discharge the duties” by proposing the long and detailed 25th Amendment, which was ratified.  The key provision addressing removal of the president states:

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President. [25th Amendment, Section 4 (emphasis added).]

It could be possible that Biden’s incapacity could become so great that even Vice President Harris and a majority of the deeply political Biden Cabinet would feel obligated to advise Congress that the President is incapable of functioning.  However, it is not impossible that these leaders and the First Lady just might want to keep him in office nevertheless.  This would not be the first time that the President’s wife ran the country.  President Woodrow Wilson suffered a stroke in October 1919, and First Lady Edith Wilson limited access to him and acted as President.  Because Wilson was not dead, nor willing to resign, and Congress would not declare him “unable to discharge” his office, Edith Wilson exercised the power of the Presidency until Wilson’s term concluded in March 1921.

To be sure, the Constitution clearly limits impeachments to “high Crimes and Misdemeanors,” and does not cover impeachment for incapacity.  However, if Biden deteriorates and the Vice President and Biden Cabinet were to refuse to use the provisions of the 25th Amendment, it is at least possible that the constitutional standard would be disregarded by Congress to remove a non-functioning President’s finger from the nuclear trigger.
