America’s Future Files Amicus Brief with SCOTUS Supporting Jan 6 Defendant

Florida – October 20, 2023 – America’s Future, Inc., a national leader in the fight to preserve individual rights, promote American values and traditions, and protect the nation’s Constitutional Republic, announced that it filed an Amicus brief with the Supreme Court of the United States (SCOTUS) in Fischer v United States (U.S.), SCOTUS Dkt. No. 23-5572, supporting the petitioner, Mr. Joseph Fischer, who has had criminal charges lodged against him for participating in the Jan 6 protest. The brief was filed on October 13, 2023, with two other nonprofits.

The brief urges the SCOTUS to intervene in Mr. Fischer’s federal criminal case in which he is accused of violating 18 U.S.C.§1512, a charge carrying a 20-year prison sentence as a penalty. The legal issue presented to the Supreme Court focuses on the proper interpretation, or legal definition, of the word “otherwise” found in the statute charged.

“America sits at a dangerous precipice,” said Mary O’Neill, Executive Director of America’s Future. “Mr. Fisher is entitled to due process, fair treatment, and equal justice under the laws just as all Americans are entitled under our Constitution. We pray that the SCOTUS seizes upon this opportunity, and all other opportunities presented to it, to protect citizens’ rights against all unlawful infringements.”

Whether the Court agrees to hear Mr. Fischer’s case in the first place, and if so, how it resolves it, could foretell the Court’s willingness to take on future cases of great significance, especially those connected to the Jan 6 protest, after which hundreds of citizens have been hunted down and charged with crimes for exercising their First Amendment rights.
