America’s Future Files Brief Defending Free Speech Against Government-Big Tech Censorship

On Monday, August 7, 2023, America’s Future filed an Amicus brief in the Fifth Circuit Court of Appeals in a blockbuster case regarding the Biden administration and its agencies’ attempt to covertly censor and suppress the free speech rights of any American who dare to debate facts, disagree with their “official” policies or oppose their political narrative.

The case is Missouri v Biden, 5th Cir. Dkt No. 23-30445, and the plaintiffs in this case include the states of Missouri and Louisiana and five individuals, all of whom have readied themselves for a court battle of epic import.  Armed with evidence and the facts on their side, the plaintiffs are taking on the biggest bullies in the schoolyard.  Only now, the bullies have formed an alliance, and they don’t fight fair.  Lies and hypocrisy are their battle cries and intimidation, abuse of power, abuse of process, and targeted persecutions-prosecutions are their swords. The defendants are intent on ruling this land and subjugating We The People.

The Fifth Circuit Court of Appeals acquired jurisdiction over the case when the defendants filed an appeal seeking to reverse last month’s July 4th Independence Day court order, which granted the plaintiffs a preliminary injunction prohibiting the federal government, its departments, agencies, and agents from continuing to assault and violate the First Amendment rights of Americans.  It was refreshing to read the 155-page Independence Day ruling of injunctive relief authored by U.S. Federal District Court Judge, the Hon. Terry A. Doughty, from Louisiana’s Western District.  

America needs more judges like him – judges that are willing to stand up for America, speak truth to power, and decide cases and controversies honestly, without fear or favor.  He shined a light into a dark abyss; he dedmonstrated that a dastardly “censorship-by-proxy” scheme was ongoing, continuous, and incessant, being carried out by a shameless executive branch and a compromised administration.

As our brief explains, “[i]n the United States, the government is [without authority to decide] ‘what actions citizens and businesses can and should take to advance the public good,‘ but rather, the People make those decisions for themselves. The government appears to have forgotten what James Madison explained so clearly, that: ‘the censorial power is the people over the government, and not in the government over the people.”  

Our brief provides well-reasoned important insight to the court and explicates the significance of this case through a historical lens at times, for example, and as set forth in our brief, “[t]he censorial actions taken by the government can neither be ignored, nor excused, for they violate one of the nation’s core principles that has never been better stated than it was by Justice Jackson seven decades ago:

If there is any fixed star in our constitutional constellation, it is that no official, high or petty, can prescribe what shall be orthodox in politics, nationalism, religion, or other matters of opinion or force citizens to confess by word or act their faith therein. If there are any circumstances which permit an exception, they do not now occur to us.

There is no good, rational, or valid reason for the Fifth Circuit to disturb the preliminary injunction ordered by the lower court in this case.  Judge Doughty’s injunction was supported with evidentiary facts, admissions, documents, and communications.  We pray the plaintiffs will prevail in this action.

The district court laid out the facts plainly and fully demonstrated that since his 2020 campaign, Joe Biden and  “crew,” including his administration, our executive branch, and the departments and agencies of our federal government, all intended and acted in a manner designed to mislead, manipulate, propagandize falsehoods, suppress dissent, suppress information undesirable to them, censor truth, censor experts, and cancel all viewpoints inconsistent with the “official” viewpoint. These acts usurped our free speech rights.  Out of desperation, a “Censorship Enterprise” was formed. Our executive branch, our federal government, a cabal of D.C. “good ole boys” politicians, and our administrative state bureaucracy tethered themselves to and found comfort from Big Tech, Big Media, Wall St., and the screaming leftists filled with vengeance and anger.

The goal of this grouping is, at its core, to dismantle and destroy the protective shield inherent in strong family units and robust communities.  America’s Future stands for freedom and reason.  We stand against censorship and compromised government officials.  We urge the Fifth Circuit to leave the lower court’s preliminary injunction undisturbed.  There is nothing righteous, just, or honorable about a “Censorship Enterprise” existing in America, especially one led by our government and working against America and her best interests.
