One Naton Under God

When our forefathers were pressed by hardship, it was their faith that got them through. Above all, it was their faith in God, the creator of all things, the giver of life. They looked at the most precious things God had granted them, their children and grandchildren, and were refreshed again in their faith.

Today, most agree that many families, and our friends, neighbors and fellow Americans are struggling. Gas to fill our cars has risen steeply and so have food prices. Institutions once highly esteemed are being questioned about their activities and some, are now held in deep suspicion. Sometimes, it’s hard to see a way forward. When we feel the situation is most dire, it’s good to remember that at times our forefathers had it just as bad, and in some cases much worse. What got them through the hard times? Their faith.

At America’s Future, we think it’s vital to draw on our great country’s past — its founding texts, its historic challenges and achievements, and its heroic men and women — to chart our way forward and shape our future. In the next featured series of our newsletter, we’ll spend time reflecting on how faith has formed American society— faith in God, faith in America, faith in our institutions, faith in each other, faith in our potential, and faith in our God-given and inalienable rights cited in the Declaration of Independence — the right to life, liberty, and the pursuit of happiness.

Recent news of the Supreme Court leak with respect to a draft opinion overturning its 1973 Roe v Wade decision that legalized abortion in this country, has landed a crushing blow to our faith in the highest court in the land by virtue of the leak. As for the issue of abortion, those that believe the willful termination of a pregnancy takes away life of the most vulnerable and innocent, the leaked document provides renewed faith in the sanctity of life. To supporters of Roe, the release of the draft opinion caused heightened concern.

In the end, the now compromised Judiciary must right its wrong to restore faith in its institution. And if the final published opinion of the Supreme Court does, in fact, overturn Roe, then the issue of abortion will be returned to the people of each state to determine the lawfulness or unlawfulness of abortion on a state-by-state basis.

When a society loses faith in its justice system or questions God-given rights to life, liberty and the pursuit of happiness, the consequences can be far-reaching. The Founders understood this basic fact.

America’s Future Files Amicus Brief
In Support of the Second Amendment

On Monday, May 2, 2022, America’s Future along with 10 other amici organizations, submitted an Amicus Brief to the United States Court of Appeals for the Ninth Circuit in connection with Todd Yukutake and David Kikukawa v. Holly Shikada, in her official capacity as the Attorney General of the State of Hawai’i, et al., No. 21-16756 (2022).  Central to this litigation is the Second Amendment of the U.S. Constitution – every American’s “right to bear arms.”

The history of the case begins on October 24, 2019, when Plaintiffs, Mr. Yukutake and Mr. Kikukawa, filed suit against then-Attorney General of Hawaii, Clare E. Connors, seeking declaratory and injunctive relief to protect their Second Amendment right to bear arms.  Their lawsuit calls into question the constitutionality of two state statutes that the Plaintiffs understood to be infringing upon their Constitutional rights.  The state statutes at issue are Hawaii Revised Statutes (“HRS”) § 134-2(e) and HRS § 134-3(c), in relevant parts mandating that (1) “that individuals purchase a handgun (pistol or revolver) within 10 days of obtaining a permit to acquire” and (2) “that individuals physically bring their firearm to the police department for in-person inspection and registration within five days of acquiring it.”

On August 16, 2021, the United States District Court for the District of Hawaii issued a memorandum opinion granting summary judgment in favor of the Plaintiffs.  In so doing, the presiding judge in the matter, Chief U.S. District Judge for the District of Hawaii, Judge Michael Seabright, declared both regulations unconstitutional and in violation of the Second Amendment. Two months later and just shy of two years following commencement of the lawsuit, Defendant appealed the grant of summary judgment to the Ninth Circuit Court of Appeals.

America’s Future along with the other named amici, posit that the Ninth Circuit Court of Appeals should affirm the summary judgement granted in favor of Plaintiffs/Appellees by Chief Judge Seabright. As concisely stated in our Amicus brief, “[t]he [Second] Amendment recognizes and protects that natural right [‘of resistance and self-preservation’] — but does not limit or diminish it. Hawaii’s progressively onerous regulatory regime stands in diametrical opposition to the [Second] Amendment’s text and the God-given right it reflects and protects.”

America’s Future fervently endorses the Second Amendment along with all God-given inalienable rights of America’s citizenship.  Our Amicus brief offers not only well-reasoned arguments in support of affirmance of Chief Judge Seabright’s decision, but also explains the historical context of the Second Amendment and the case law arising from it.  The brief reiterates the import of America’s framework and serves as a reminder to never forget and never lose sight of how the creation of our nation came about – that is, through the blood, sweat and tears of the colonists, our forefathers who, with valor and determination, fortified and secured the Constitutional Republic of the United States of America.

Freedom of speech is not only a God-given right and was protected as such in 1791 with the ratification of the Bill of Rights, it also has been declared a fundamental human right by the United Nations (UN) General Assembly as set forth in the UN’s 1948 Universal Declaration of Human Rights (UDHR) and formally memorialized as a UN Official Document.  

America was ahead of its time.  It took member states of the UN nearly 150 years before acknowledging that all people are “endowed with reason and conscience” and further recognized the core principles and God-given rights, inalienable and essential to overcome tyranny and oppression:  life, liberty, dignity, fairness and equality under the law.  

Freedom of speech is so treasured by rational decent societies and free-thinking citizens of the world that declaring the importance of this freedom and God-given human right was placed in the Preamble of the UDHR, as well as Article 19, which states, “Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.”

For America and all other civilized nations, freedom of speech serves as a primary function to ensure a successful and effective system of self-governance – a Constitutional Republic. It is necessary to advance meritorious ideas, improve the use of reason and rational thinking, encourage fair and fearless debate, promote public discussion, guarantee accountability and ultimately guide an informed citizenship and rational society towards meaningful participation in community and government.
