Failed Justice Demands Accountability

Be angry America. Be really angry. And, now, put that anger to good use by raising your voice in fearless unison to bring accountability to the corrupt scoundrels out to destroy this country.

The long-awaited Durham Report is out. But Americans who love their country and abide by the law will not be satisfied. Instead of issuing indictments against the despicable Obama-Biden-Clinton crew and their deputies who perpetrated one of the greatest crimes against this country, the Durham report leaves us simply with 306 pages of words on paper.

We have a right to be angry. Americans deserve better. Where is the justice? Where is the accountability to hard-working Americans who were duped, force-fed as fact the Russia hoax for nearly a decade? Where are the consequences for the cabal of power-hungry liars who set the witch hunt in motion in 2016, bastardized the U.S. Constitution, lodged false charges against innocent Americans while illegally spying on them, weaponized our system of justice, used their positions to interfere in an election and then the transfer of power, and spit on the sanctity of this nation’s rule of law?

The survival of the United States of America is now in the hands of We The People. The Durham Report makes that crystal clear with this one statement: “Our investigation determined that the Crossfire Hurricane investigators did not and could not corroborate any of the substantive allegations contained in the Steele reporting.” Yet, the report makes no criminal referrals. Instead of pursuing justice against the criminals, it whitewashes their crimes.

Funded by the 2016 Hillary Clinton campaign, the so-called Steele Dossier was the discredited evidence used by Obama’s Department of Justice and FBI to open a broad investigation — called Crossfire Hurricane — against innocent Americans to destroy their lives and families, ruin their reputations and bankrupt them. It was the premise used to conduct a coup against the entire country and the President we elected, Donald J. Trump. It was the trigger that sparked the Obama regime’s intelligence community assessment, the post-election report that falsely linked President Trump and his supporters to Russia. It was the source of a hailstorm of media lies that supported the conspiracy against the American public known as Russiagate.

On April 10, 2016, a few short months before his spy chiefs began their surveillance and propaganda operation against Trump’s presidential campaign, Obama sat for an interview on Fox News Sunday and told America, “I do not talk to the Attorney General about any investigations. I do not talk to any FBI directors about pending investigations. We have a strict line and always have maintained it. I guarantee that there is no political influence in any investigation conducted by the justice department or the FBI not just in this case [the investigation of Hilary Clinton’s use of a private server] but in any case. Full stop. Period.”

We must not forget that the man ultimately responsible for endangering the country’s national security and inflicting injustice and corruption on America is Barrack Obama. At least the Durham Report recognizes that his Department of Justice and FBI “failed to uphold their important mission of fidelity to the law.”

If those law enforcement officials were not faithful to the law, then they committed crimes. And if they committed crimes and are not charged with those crimes, then the Durham Report is meaningless, and justice is not served. And that, my fellow Americans, is shameful.

But Patriots rise to the occasion when the battle lines are drawn. It’s in our DNA. It is the history of this country’s citizens’ relentless fight for freedom over generations.

The time is now. It is time to raise your voice, be brave, be courageous in the face of challenge, and never surrender.

There is an election on the horizon. The Uniparty and its partners in the propaganda press are coming after We The People with all they have — ballot malfeasance and bundles of cash for corporate honchos and Big Tech to interfere in the 2024 election. Now is the time to put your anger to use and stand tall for the truth, election integrity, and American values and see to it that those who injured the United States of America and targeted Americans are held to account.

We spoke with General Flynn recently about the Durham Report, and how he weathered the storm of political persecution.

What was your first impression when you read the Durham Report, and what message do you have for Americans who want to see accountability?

I felt like a little bit more of America died once again. When we fail to hold to account any government official that abuses their position especially when it hurts those who they are supposed to protect and serve, it has devastating impacts. The lack of accountability is severe, and if no accountability comes out of this report, the rule of law in America will cease to exist.

The Deep State tried to destroy you, but you walked through the fire with your head up. What advice do you have for our fellow Americans about how to weather and defeat the demonic campaign targeting our country right now from the inside?

Pray and return to whatever faith you have and never allow others to define you. Only you can define yourself, and when you are able to overcome the fear of being verbally attacked, you’ve won.

You have long encouraged Americans to take action locally because, in your words, “local action has a national impact.” Many Americans have taken on the challenge. Do you have any further advice to share with Americans who want to lead their communities toward a brighter future?

Study your communities. Understand who the people are and what the local challenges are, and never be afraid to speak up about the things that are impacting the lives of those living in your community. And if possible, get involved politically and maybe even consider running for a local office.

You’re part of the ReAwaken America Tour, which just had a big event in Miami last weekend. Can you talk about the great patriots that came to hear you, Clay Clark, Devin Nunes, Kash Patel, and others speak?

Those who attend the Reawaken America events are people who want to learn more about how to get involved in the fabric of America. The Reawakening events are two days spent together, providing a master’s degree in constitutional issues and other issues that impact the daily lives of millions upon millions of Americans across the entire political spectrum.

Do you have a favorite passage from scripture that helped sustain your faith in a time of darkness? Are there any expressions or maxims that inspire you during dark days?

There are two: PSALM 23 and Fight Like A Flynn.

DOE Determined To Exceed Authority At The Risk Of Young Women’s Safety

On Monday, May 15, 2023, America’s Future submitted comments opposing the U.S. Department of Education’s (DOE) Notice of Proposed Rulemaking (NPRM) published in the Federal Register on April 13, 2023, announcing the intention of the Biden DOE to amend the Education Amendments of 1972, specifically Title IX, in a manner blatantly contravening the expressed will of Congress and patently detrimental to young women. Two other organizations joined in the submission.

Disingenuously coined, “Nondiscrimination on the basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance: Sex-Related Eligibility Criteria for Male and Female Athletic Teams,” the text of this proposed ruledemonstrates that Biden’s DOE is so emboldened that it will unabashedly usurp the legislative powers of Congress as a means to its end. And what, exactly, is that end? The intolerable incessant efforts to experiment with the safety, security, and well-being of teenage girls by the executive branch. Its encouragement of young males to join interscholastic female sports teams, designed specifically to give young women a fighting chance at college sports scholarships and other prized sports awards and honors, is simply unjust and cruel.

Why negate all the strides young women in sports have made since the 1970s? Why jeopardize all the benefits earned by young women excelling in athletics – the self-confidence gained by accomplishment, and the countless other rewarding aspects of participation in competitive girls’ sports teams?

Not only does the Biden DOE appear to care less, it continues to ignore the detrimental consequences to young women that arise out of its actions. The harmful stance it takes demonstrates contempt for all those born female while exposing high-school-aged (and younger) girls to unsafe, unnatural, and vulnerable situations. This latest attempt by Biden’s DOE to impose a radical agenda on the youth of America by redefining gender to erase the 50 years of favored results under Title IX is not only destructive, but it is unconscionable and entirely reckless.

As stated on page 2 of our comments, “Title IX was designed to remedy an unequal playing field in scholastic sports to elevate the opportunities for females to the level of males. The proposed rulemaking is designed to elevate the opportunities for males to intrude into female sports and facilities. Not only is it an impermissible departmental construction of Title IX, but it would also undermine Title IX.”

Biden’s DOE shall exceed its authority if it attempts to amend Title IX, a landmark law, by way of this abhorrent DOE scheme to redefine words that are not up for interpretation. We, at America’s Future, call on the DOE to withdraw its NPRM and cease and desist from the vulgar offenses it continues to inflict against women and girls in violation of the law.

Round-Up of Recent SCOTUS Decisions

Since the Supreme Court of the United States (SCOTUS) Round-Up we published in our March 3, 2023 newsletter, SCOTUS has resolved an additional sixteen cases from its October 2022 term. To keep our readers well-informed, below are some of the recent decisions, including Twitter, Inc. v Taamneh (21-1496). Stay tuned next week for more SCOTUS rulings that can impact our daily lives. Twitter, Inc. v Taamneh (21-1496)
ISSUE: Whether Plaintiff’s allegations that the social media company defendants aided and abetted ISIS in its terrorist attack at a nightclub in Istanbul, Turkey are sufficient to state a claim suitable for litigation under 18 USC § 2333(d)(2) which “imposes civil liability on ‘any person
who aids and abets, by knowingly providing substantial assistance, or who conspires with the person who committed such an act of international terrorism’.”

RULING: No. “Plaintiffs’ allegations are insufficient to establish that these defendants aided and abetted ISIS in carrying out the relevant attack.” – The U.S. Court of Appeals for the Ninth Circuit is reversed.

Reed v Goertz (21-442)
ISSUE: Whether the statute of limitations on a §1983 denial of due process claim begins to run at the end of a criminal trial or after appeals are exhausted.

RULING: It depends. When a prisoner pursues state post-conviction DNA testing through the state-provided litigation process, the statute of limitations for a § 1983 procedural due process claim begins to run when the state litigation ends, in this case when the Texas Court of Criminal Appeals denied Reed’s motion for rehearing.” According to SCOTUS, the statute begins to run when the “state’s alleged failure to provide a fundamentally fair process is complete.” – The U.S. Court of Appeals for the Fifth Circuit is reversed.

Percoco v US (21-1158)
ISSUE: “Whether a private citizen with influence over government decision-making can be convicted for wire fraud on the theory that he or she deprived the public of its ‘intangible right of honest services [under 18 U. S. C. §§1343, 1346]’.”

RULING: Generally no, but no bright-line rule in this case. Although reversed on different grounds, SCOTUS, in dicta, reveals, “We reject the argument that a person nominally outside public employment can never have the necessary fiduciary duty to the public…however…’[t]he intangible right of honest services’ codified in §1346 plainly does not extend a duty to the public to all private persons.” – The U.S. Court of Appeals for the Second Circuit is reversed and the case is remanded.

Ciminelli v US (No. 21-1170)
ISSUE: “Whether the Second Circuit’s longstanding ‘right to control’ theory of fraud describes a valid basis for liability under the federal wire fraud statute, which criminalizes the use of interstate wires for ‘any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises.’ 18 U. S. C. §1343.” SCOTUS notes “[u]nder the right-to-control theory, a defendant is guilty of wire fraud if he schemes to deprive the victim of ‘potentially valuable economic information’ ‘necessary to make discretionary economic decisions’.”

RULING: No. “The federal fraud statutes criminalize only schemes to deprive people of traditional property interests. Because ‘potentially valuable economic information’ ‘necessary to make discretionary economic decisions’ is not a traditional property interest, we now hold that the right-to-control theory is not a valid basis for liability under §1343.” – The U.S. Court of Appeals for the Second Circuit is reversed, and the case is remanded.

Santos-Zacaria AKA Santos-Sacarias v Garland (21-1436)
ISSUE: Whether, “under 8 U. S. C. §1252(d)(1), a noncitizen who seeks to challenge an [Administrative adjudicatory] order of removal in court must first exhaust certain administrative remedies [8 U. S. C. §1252(d)(1) provides: ‘A court may review a final order of removal only if . . . the alien has exhausted all administrative remedies available to the alien as of right’].”

RULING: No. SCOTUS indicates the statutory provision under review in this case “lacks the clear statement necessary to qualify as jurisdictional.” Further, statutory provisions that are jurisdictional can have harsh consequences and, therefore, courts should treat statutes or provisions as jurisdictional only if “Congress clearly states that it is.” This is because the question of jurisdiction can divest a court of authority over a case which can be a harsh consequence.
Here, SCOTUS determined that 8 U.S.C.§1252(d)(1) is not jurisdictional, and therefore “a noncitizen need not request discretionary forms of administrative review, like reconsideration [of an unfavorable Administrative Fair Hearing Appeals determination, in order to seek court intervention].” – The Dismissal issued by the U.S. Court of Appeals for the Fifth Circuit is vacated, in part, and the case is remanded.

Congress Must Defund Massive FBI Expansion

This is the fourth entry in our IN FOCUS section highlighting some of the most abusive and oppressive federal agencies and programs that House Republicans should target for ending. Readers will find the first two articles of the series here.

In August 2022, Joe Biden proposed to give the IRS $80 billion over the next decade to hire 87,000 new IRS agents. When the IRS issued a job posting seeking agents to hire, it sought those who would “carry a firearm and be willing to use deadly force if necessary,” conservatives exploded with justifiable outrage. In January, House Republicans acted to defund those 87,000 new agents in the debt ceiling increase bill passed by the House. We shall see what happens to that effort in the ongoing debt ceiling negotiations.

However, receiving considerably less notice is a huge appropriation to build a new FBI headquarters and more money which doubtless will be used to investigate and prosecute its political opponents. Amazingly, the new FBI building would be fully twice the size of the Pentagon.

Aside from the sheer magnitude of the building, we have Biden Administration priorities baked into the construction: “Riveted into the colossal new project are woke regulations to ensure that the FBI center will comply with diversity, equity, LGBTQ+, and climate change political goals.” The government’s General Services Administration:

set out five criteria for choosing the property…. Of those five criteria, cost to the taxpayer is viewed as least important. The equitycriterion, to comply with diversity and climate-change executive orders signed by Joe Biden, is weighted as 50 percent more important than the cost. The site, design, and structure of the new FBI headquarters must “advance racial equity and support for underserved communities through the Federal Government,” GSA says…. [Emphasis added.]

Giving this rogue agency a vast new complex larger than the entire Kremlin complex in Moscow, while steeping it in woke ideology and Green New Deal nonsense, is the height of folly. (By the way, Wikipedia explains that the word “kremlin” means “fortress inside a city.”) House Republicans must use the power of the purse to stop the FBI’s runaway trajectory. There are a number of tactics the House should employ.

Congressman Matt Gaetz (R-FL) recently introduced the “FBI Washington Field Office House Arrest Act,” calling for the House to halt all spending on the new FBI building. “The cancer at the Washington Field Office has metastasized so large that the entire body is in critical condition,” Gaetz said. “Gifting the FBI a new headquarters larger than the Pentagon would condone, reinforce, and enable their nefarious behavior to levels we have never seen before.”

The FBI budget in FY 2001 was $3.33 billion. Today, it is nearly $11 billion. There are some 37,000 FBI agents — enough, apparently, to raid former Presidents’ homes and to arrest pro-life protestors at gunpoint. And 37,000 agents are enough to launch a political hit on President Trump with the phony “Russia collusion” story that special counsel John Durham’s report has now concluded never should have happened. Even CNN’s Jake Tapper noted, “It is regardless devastating to the FBI and, to a degree, it does exonerate Donald Trump.”

As the Gaetz’ legislation notes, “constructing a new headquarters for the Federal Bureau of Investigation at this time would distract from critical oversight of this dangerous politicization … [and] it is entirely inappropriate for a domestic law enforcement agency that employs 2.3 percent of the manpower of the United States military to receive a headquarters larger than the Pentagon….”

The estimated price tag for the new headquarters — before federal contractors start piling up cost overruns — is $4 billion.

After the Durham Report was released on May 15, 2023, Gaetz tweeted, “The Durham report is an absolutely DAMNING treatise on the weaponization of the FBI against President Trump. This should be a clarion call for legislative reform. We need to defund and deauthorize government entities that are converted from the just cause of defending our nation into enforcement wings of political parties.” Missouri GOP Senator Josh Hawley added, “There needs to be consequences. FBI leadership has clearly got to be changed…I’m of the mind we need to end the FBI as we know it. It needs to be broken up.” House Judiciary Chairman Jim Jordan agreed: “The only way we can hold them accountable is to go at the one thing that everybody cares about — the money…We have to look at the appropriations. That’s the only leverage we ultimately have in Congress.”

Hawley, Jordan, and Gaetz are absolutely right. House Republicans must not be complicit in building a massive new complex to reward the FBI for its misdeeds and expand the FBI’s capability to launch political persecution of political opponents. The FBI has openly declared war on conservative and Christian dissent in America. House Republicans can no longer play political games. They need to step up and stop the FBI’s latest power and money grab, and defunding the woke new FBI headquarters boondoggle would be a great place to start.
